1. Acceptance of Terms
These Terms and Conditions (the “Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Bloo Lizard, LLC (“Company,” “we,” “us,” or “our”) governing your access to and use of our applications, websites, courses, and community platforms (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict‑of‑law provisions.
3. Eligibility & Accounts
- Minimum Age: The Service is intended for individuals at least 13 years of age. By creating an account, you represent that you meet this requirement.
- Account Creation: Access to most features requires an account with accurate, current information. You are responsible for safeguarding your credentials and for all activity under your account.
- Account Ownership: Accounts are personal and non‑transferable. We may require verification of identity.
4. Fees, Payments & Refunds
- External Checkout: Purchases and subscriptions are processed via third‑party providers, including GoHighLevel and Stripe (each a “Payment Processor”). We do not store full payment card details.
- Billing Terms: Your transactions are also governed by the terms of the applicable Payment Processor.
- Refunds: Unless expressly stated at purchase, all sales are final. Refunds, if any, are provided at our sole discretion consistent with applicable law.
5. Community Guidelines
We expect respectful, professional conduct. The following are prohibited: harassment, discrimination, hate speech, threats, doxxing, spamming, illegal activity, infringement, or content that is obscene, exploitative, or otherwise harmful. We may remove content, restrict features, or suspend/ban accounts at our discretion to protect users and the integrity of the Service.
6. Intellectual Property
- Company Materials: The Service, including software, apps, course content, designs, text, graphics, trademarks, and logos are owned by Bloo Lizard, LLC and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, display, sell, or create derivative works from Company materials without prior written consent.
6.1 User Content & License
- Ownership: You retain all rights to the content you submit, post, or upload (“User Content”).
- License to Company: By submitting User Content, you grant Bloo Lizard, LLC a non‑exclusive, worldwide, royalty‑free license to host, store, reproduce, display, and distribute such content solely for operating and improving the Service, including community features and course areas. You may revoke this license by removing your content, except to the extent copies are required for backups, legal compliance, or ongoing discussions where removal would break context.
- Share Permissions: Do not share Company materials externally without written permission. You are responsible for obtaining rights to any third‑party content you upload.
7. Prohibited Uses
- Accessing or using the Service for unlawful purposes or in violation of any applicable law or regulation.
- Attempting to interfere with, compromise, or circumvent security or access controls.
- Scraping, harvesting, or automated data collection without written consent.
- Reverse engineering, decompiling, or attempting to extract source code except where permitted by law.
8. Third‑Party Services
The Service may contain links to or integrate with third‑party websites, products, or services (including Payment Processors). We do not control and are not responsible for such third parties, their content, or their practices. Your use of third‑party services is at your own risk and subject to their terms and policies.
9. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR EXPECTATIONS, ACHIEVE SPECIFIC RESULTS, OR BE UNINTERRUPTED OR ERROR‑FREE. EDUCATIONAL, COACHING, OR INFORMATIONAL MATERIALS DO NOT CONSTITUTE PROFESSIONAL ADVICE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BLOO LIZARD, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES. IN ALL EVENTS, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO BLOO LIZARD, LLC FOR ACCESS TO THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
11. Indemnification
You agree to indemnify, defend, and hold harmless Bloo Lizard, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.
12. Suspension & Termination
We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, present a risk, or fail to pay required fees. Unless exigent circumstances apply (e.g., legal or security risks), we will provide a seven (7) day grace period before permanent termination. Upon termination, rights and licenses granted to you under these Terms will immediately cease.
13. Changes to Terms
We may update these Terms from time to time. Updates will be posted here with a revised effective date. Your continued use of the Service after any update constitutes acceptance of the revised Terms.
